Rules Guide

Introduction

There are four sources of Rules concerning rights and responsibilities of owners and residents. These are.
  1. Declaration,
  2. By-laws of the Corporation,
  3. Rules of OCSCC No. 815, and
  4. Rules enacted by the Board of Directors.
These rules are binding on all owners and residents.  See also Declaration section 9.1. All owners and residents should carefully read the Declaration, By-laws and Rules of OCSCC No. 815.

General

  1. The Rules following expand or elaborate on the documents listed above.
  2. These Rules may also deal with operational aspects not addressed in the documents.
  3. Rules as deemed necessary and enacted or altered from time to time by the Board shall be binding on all owners and residents. Owners and residents shall be responsible to ensure compliance with the rules by any persons occupying or present in the suite with their approval.
  4. In these Rules, the term “suite” is used in lieu of multiple terms such as “dwelling units”, “residential units” or just “units” used in the Condominium Act, Declaration, Rules and By-laws.
  5. The term “owner” shall include the owner or any other person occupying or present in 90 George with the owner’s approval. The term “resident” is used herein to include a resident owner or a tenant of 90 George, unless otherwise specified.
  6. Rules are arranged alphabetically by topic. The headings are only for ease of reference and do not form part of the Rules.

Absences

Residents shall advise the Front Desk of absences of more than five (5) days, and provide the coordinates of a contact person or of persons who will be occupying or accessing the suite in such resident’s absence.  See also OCSCC 815 Rule 4 (d).

Advertising and Bulletin Boards

No sign, advertisement or notice shall be inscribed, painted, affixed or placed on any part of the inside or outside of the building including windows or common elements whatsoever except where authorized by the Board.  See also OCSCC 815 Rule 7 (c).

Alterations

Owners and residents shall not make any architectural, plumbing, electrical, mechanical, structural or flooring alterations in or to the suites without the prior consent of the Board.  See also OCSCC 815 Rule 8 (a) and 9, and By-Law #3.  See also Contractors item below.

Balconies

1.  Each resident shall have the exclusive use of any balcony and/or any terrace or roof deck directly adjoining their suite to which the suite has sole and direct exclusive access.   See also Declaration schedule “F”. 2.  Balconies and terraces shall not be altered, including decorated or painted, without the prior written consent of the Corporation.  See also Declaration section 4.1 (h). 4.5 3.  No mops, brooms, dusters, rugs or bedding shall be shaken or beaten from any window, door, balcony or terrace.  See also OCSCC 815 Rule 1 (e). 4.  No hanging or drying of clothes or other items is allowed on any balcony or terrace. 5.  Balconies and terraces shall be kept clean and free from debris.  Balconies and terraces shall not be used for storage of personal possessions, with the exception of seasonal furnishings.  No umbrellas shall be permitted.  All items must be heavy enough or secured to ensure they are stable in strong winds.  No flower boxes or other items shall be affixed to railings, walls or any part of the exterior of the building.  See also OCSCC 815 Rule 7 (g).   6.  Barbecues may not be operated on balconies, with limited and specific exceptions.  See also OCSCC 815 Rule 6 (d). 7.  Nothing shall be thrown, dropped or otherwise ejected from balconies, terraces, windows and doors. 8.  To prevent deterioration of balcony floors due to moisture, any carpeting or coverings thereon shall be removed during rainy periods and winter months. 9.  Food shall not be left on a balcony unattended, as it attracts pigeons and other creatures. Barbecues

There are two BBQ areas available for the use of residents on the Terrace.  One can be booked in advance through the Front Desk.  See also OCSCC 815 Rule 11 (e) (vi). Barbecues may not be operated on balconies, with limited and specifc exceptions.  See also OCSCC 815 Rule 6 (d).

Bicycle Storage and Use

1.  No bicycle shall be placed, located, kept, maintained or stored in suites or common elements except in the designated bicycle storage room for the use of residents on garage level P3, or on approved storage racks in residents' parking spaces.  See also OCSCC 815 Rule 7 (f).  For information about bicycle racks, please contact the front desk at 613-680-5781 or at frontdesk@90georgeliving.com. 2.  Bicycles shall only be taken out or in through the parking garage ramps.  Bicycles shall not be taken on elevators or through common areas.  See also OCSCC 815 Rule 7 (f).

Building Access Devices - See Fobs

Car Wash

No car washing is permitted on any parking unit or common element except for the designated car wash bay located on P3.  See also OCSCC 815 Rule 10 (c).

Christmas Trees

Christmas tree bags must be used when bringing real Christmas trees into and out of the building.   The use of Christmas tree bags greatly reduces needles, sap and dirt left in common areas, elevators and hallways.   Christmas tree debris in common areas must be cleaned up by the owner.

Comfort and Quiet Enjoyment

Residents shall not create, or permit the creation of or continuation of, any noise or nuisance which, in the sole discretion of the Board, may or does disturb the comfort or quiet enjoyment of the property by other residents or their guests.  See also OCSCC 815 Rule 1 (c)-(d).  For detailed instructions, see Handbook/Living Here/Quiet Enjoyment Section of this Website.

Common Elements

Common elements comprise all of the areas of the property which are not designated as suites.  Each resident has the full use, occupancy and enjoyment of the whole or any part of the common elements, except as otherwise provided.  See also Declaration section 3. Nothing shall be placed or left in or upon the common elements by residents. This includes but is not limited to shoes or winter boots outside one’s suite door, furniture, benches, mats, shopping carts, garbage. Residents shall be responsible for any manner of defacement or damage they cause or contribute to, of any common element.  See also OCSCC 815 Rule 7 (a).

Contractors

Contractors are permitted to work in the building, with prior approval of Property Management, weekdays (excluding statutory holidays) between 9:00 a.m. and 5:00 p.m.  See also OCSCC 815 Rule 1 (d) and 9 (g).

Deliveries

When a resident is not in when a delivery arrives, the Front Desk accepts the delivery/parcel and later informs the resident as soon as is reasonably convenient.  The Front Desk does not accept cash, registered mail, deliveries for non-residents, or anything that cannot be reasonably carried by one person.  See also OCSCC 815 Rule 5 (b) and Delivery of Large Items below.

Dining / Meeting Room - See Party / Meeting Room

Dress Code 

Proper attire, such as a robe or track suit, shoes or sandals, must be worn at all times in all common areas and when going to, or coming from the 90 George Resident Amenities areas.  Appropriate bathing apparel must be worn in the pool area.  Bare feet or wet bathing suits are not permitted in the lobby, elevators and corridors.  See also OCSCC 815 Rule 11 (a)(i), (c)(i), (e)(ii).

Electric Cars, etc.

No batteries, electric cars, tools, or other items shall be plugged into electric outlets on any part of the common elements, including any part of the parking garage. See also OCSCC 815 Rule 10 (b).

Electrical

Residents shall not overload electrical circuits. See also OCSCC 815 Rule 6 (b).

Emergencies

In case of emergency, an agent of the Corporation may enter a suite at any time and without notice,  for the purpose of repairing the suite or common elements or for the purpose of correcting any condition which might result in damage or loss to the Property.  See also Declaration section 4.4 (b).  For detailed instructions, see Handbook/Emergency, Fire and Evacuation Section of this Website

Exercise Room

The fitness equipment in the fourth floor exercise room shall be used at the residents’ sole risk.  Children under fourteen (14) years of age are not permitted to use the equipment in the exercise room.  See also OCSCC 815 Rule 11 (b).

Exterior Appearance

Owners and residents shall only install window coverings in an off-white or white colour as visible from the outside.  This includes such items as curtains, drapery, blinds, and wooden shutters.  Residents shall not alter the interior design or colour of any part of a suite or balcony area where such change, alteration or decoration is normally visible from the exterior.  See also OCSCC 815 Rule 8 (b). Nothing shall be placed on the inside or outside of windows, sills, projections, balconies, terraces or common areas without the prior consent of the Board of Directors.  See also OCSCC 815 Rule 7 (c) and (g).

Fire Risk and Hazardous Material

Do not create fire hazards.  This may include, but is not limited to, placing flammable liquids or burning materials (including cigarettes and ashes) into garbage bins or chutes, having burning materials (including cigarettes and ashes) on balconies and terraces, and using unsafe electrical equipment.  No coal or any combustible materials or other offensive goods, such as propane and natural gas tanks, fuels, firecrackers or other fireworks, shall be stored or kept in suites, storage lockers, or on common elements.  See also OCSCC 815 Rule 6 (a).   For detailed instructions, see Handbook/Emergency, Fire and Evacuation Section of this Website

Floors

All floors, except kitchen, entrance foyer and bathrooms, shall be covered with area rugs to sixty-five percent (65%) of the total floor area of the suite in order to reduce transmission of sound.  Owners and residents shall install prior to installation, suitable sound attenuation materials as approved by the Board.  See also Disclosure Statement section 4.8 (c).

Fobs

Building access devices (Fobs) are made available only to the Corporation, an owner or occupant of a dwelling unit.  See also OCSCC 815 Rule 4 (c) and (e).

Garbage Disposal

All garbage shall be properly bound and disposed of.  See also OCSCC 815 Rule 13 (a) to (c).  For detailed instructions, see Handbook/Living Here/Garbage and Recycling Systems Section of this Website.

Garburators

Do not use garburators, and they are prohibited by law.

Hot Tub

The hot tub is accessible on a 24-hour basis.  However, if any disturbance is reported, users of the hot tub will be requested to leave.  A maximum of two guests per suite is allowed per visit.  Appropriate bathing apparel shall be worn in the hot tub.  Proper attire, such as a robe or track suit, shoes or sandals, must be worn when going to, or coming from the hot tub area.  Bare feet or wet bathing suits are not permitted in the lobby, elevators and corridors.   Drinking alcohol, eating, smoking, and glass containers are prohibited in the hot tub area.  Children under twelve (12) years of age must be accompanied and supervised by an adult sixteen (16) years of age or older.  see also OCSCC 815 Rule 11 (c).  For detailed instructions, see Amenities Section of this Website.

Insurance

Landscaping

No one shall harm, mutilate, destroy, alter or litter any of the landscaping work on the property, including grass, trees, shrubs, hedges, flowers and flower beds.  See also OCSCC 815 Rule 7 (a).

Leasing of Suites

Owners leasing their suites must provide the Property Manager with Form 5 (OCSCC 815 Rules, Schedule 2) duly completed. See also OCSCC 815 Rule 3 (a) to (e).  For further details, see Handbook/Living Here/Renting Your Unit Section of this Website.

Liability of Owner

Any loss, cost or damages incurred by the Corporation by reason of a breach of any rules in force by any owner, his or her family, guests, servants, tenants, agents or occupants of his or her suite, shall be borne by such owner and may be recovered by the Corporation against such owner in the same manner as common expenses.  See also OCSCC 815 Rule 3 (d) and 14 (b).

Locks

Owners and residents shall not place on access doors to their suites additional or alternate locks, without the written and prior approval of the Board.  All door locks and keys must be compatible with the existing lock systems and a copy of each new key must be delivered to Property Management.  See also OCSCC 815 Rule 4 (c). Residents who have not followed the above procedures will be held responsible for the cost of all damages as a result of forced entry during an emergency.

Maintenance and Repairs

Each owner shall be responsible for repairs and maintenance of his or her suite, parking unit, balcony or terrace, and storage unit.  See also Declaration section 5, and OCSCC 815 Rule 10 (j).

Motor Vehicles

No motor vehicle, including private passenger automobiles, station wagons, sports utility vehicles and motorcycles shall be parked on any common elements except in designated parking spaces.  Motor vehicles shall not be driven on any part of the common elements at a speed in excess of ten (10) kilometres per hour. Motorcycles

No motorcycle shall be parked on any common element except in designated parking spaces.  Motorcycles shall not be driven on any part of the common elements at a speed in excess of ten (10) kilometres per hour.  Motorcycles are required to park on a pad approved by Property Management so as to ensure the floor is not damaged. Moving or Delivery of Large Items

When a move, or the delivery of a large item, is being arranged, the Front Desk shall be informed well in advance of the move or delivery.  See also OCSCC 815 Rule 3 (b), 5 (a) and (b), 10 (i) and 12 (a) to (d). See also Agreement Form for Moving and Agreement Form for Deliveries, as attached below (at the end of this section). Owners and movers must be careful not to damage the common elements, including the lobby and elevators.  All damages occurring during a move will be charged back to the owner. Forms for moving and delivery of large items must be completed and submitted to the Front Desk in advance of the planned move/delivery.  Forms can be obtained in hard copy or electronic form from the Front Desk. Noise - See Comfort and Quiet Enjoyment

Obstruction 

The sidewalks, entries, driveways and corridors used in common by the residents shall not be obstructed by any of the residents or used by them for any purpose other than for ingress and egress to and from their respective suites, the building, or some other parts of the common elements.  See also OCSCC 815 Rule 7 (d) and (e).

Parking Units

Parking units shall be used for no other purpose than to park one operable passenger vehicle (and one motorcycle, as described in OCSCC 815 Rule 10 (a) ). Except as aforementioned, parking is not permitted on any part of the common elements.  Motor vehicles, including residents’ vehicles, which are improperly parked on the property, shall be tagged and/or towed.  See also Declaration section 4.2, Schedule “C” (C) and (D), and OCSCC 815 Rule 5 (c) and 10 (a) to (m).

Parking Units Rental

Parking units shall only be rented to an owner, tenant or licensee of a dwelling unit or commercial unit in this building, or to the Corporation.  See also Declaration section 4.2 (c).

Party / Meeting Room

Pets

The term “pet” shall mean a caged bird, aquarium fish, one (1) domestic cat or one (1) dog not exceeding twenty-five (25) pounds/eleven point three (11.3) kilograms in weight (or that will not exceed twenty-five (25) pounds/eleven point three (11.3) kilograms in weight when fully grown).  In the event that such pet becomes a nuisance and causes unreasonable interference with the use and enjoyment by residents of other suites and the common elements, the Board may require the pet owner to permanently remove such pet from the property upon two weeks’ written notice.  See also OCSCC 815 Rule 2 (a) to (g).  For further details, see Handbook/Living Here/Pets Section of this Website. Recycling

In accordance with the City of Ottawa Waste Management Program in which 90 George participates, residents are required to separate recyclable waste materials, such as glass, metal, plastic, paper and cardboard, from other waste and deposit these items in the garbage chute.  For detailed instructions, see Handbook/Living Here/Garbage and Recycling System Section of this Website.

Satellite dishes

No structures, including satellite dishes, may be placed on the common elements including exclusive use common elements except as permitted under the Declaration and/or by-laws of the Corporation.  See also OCSCC 815 Rule 7 (b).

Saunas

Proper attire must be worn when using, and going to or coming from the sauna.  Children under fourteen (14) years of age are not permitted to use the sauna.  See also OCSCC 815 Rule 11 (b) (i).  For detailed instructions, see Amenities Section of this Website.

Smoke Detectors

Owners or residents shall ensure that smoke detectors are in good operating order at all times and shall not tamper with nor cause them to unnecessarily activate.  See also OCSCC 815 Rule 6 (e) and 4 (f).

Smoke-Free Environment

Smoking is prohibited in all areas of the building including common elements, exclusive use common elements, suites, the parking garage, as well as on the fourth-floor terrace.  See also OCSCC 815 Amended Rules 2018.

Speed Limit

Motor vehicles, including private passenger automobiles, station wagons, sports utility vehicles and motorcycles shall not be driven on any part of the common elements at a speed in excess of ten (10) kilometres per hour.  See also OCSCC 815 Rule 10 (d).

Storage Units

Storage units shall be used for the sole purpose of storing personal belongings.  No owner of a storage unit shall sell, transfer gift, or otherwise dispose of their unit except to another owner, the Corporation, the Commercial Condominium of the Declarant.  See also Declaration section 4.3 and Schedule “C” (C) and (D). No coal or any combustible materials or other offensive goods, such as propane and natural gas tanks, fuels, firecrackers or other fireworks, shall be stored or kept in storage units. See also OCSCC 815 Rule 6 (a). Perishable foods, which could result in a pest infestation, shall not be stored in storage units.

Suites

Suites shall be occupied and used for residential single family purposes and for no other purposes.  See also Declaration section 4.1, and OCSCC 815 Schedule 4, Rule 3 (a).  The boundaries of suites are described in Declaration section 1.4, and Schedule “C” (A) and (B).

Swimming Pool

The swimming pool is accessible on a 24-hour basis.  However, if any disturbance is reported, users of the swimming pool must leave upon request.  A maximum of two guests per suite is allowed per visit.  Appropriate bathing apparel shall be worn in the pool area.  Proper attire, such as a robe or track suit, shoes or sandals, must be worn when going to, or coming from the pool area.  Bare feet or wet bathing suits are not permitted in the lobby, elevators and corridors.   Drinking, eating, smoking, and glass containers are prohibited in the pool area.  Children under twelve (12) years of age must be accompanied and supervised by an adult sixteen (16) years of age or older.  See also OCSCC 815 Rule 11 (c).  For detailed instructionssee Amenities Section of this Website.

Terrace

The Terrace is located on the fourth floor.  Access is through the Resident Amenities area. There shall be no music, excessive noise, smoking, pets, glass containers, unsupervised children, portable BBQs, or excessive use of alcohol on the Terrace.  Proper dress, including shirts and footwear, shall be worn. If any disturbance is reported, users of the Terrace must leave upon request.  No group of more than ten persons will be allowed without the prior written approval of the Board of Directors.  See also OCSCC 815 Rule 11 (e) (i to vi), and Terrace Policy under Amenities Section of the Website.See also OCSCC 815 Rule 11 (c).  For detailed instructions, see Amenities Section of this Website.

Whirlpool - See Hot Tub

Window Coverings

All window coverings must be an off white or white colour on the back side if they are to be seen from outside. See also Rule 8 b) and Declaration section 4.1 g).
