Smoking and Tenancy/Family Rules

RE: RULES UPDATES: 1. Rules Respecting Smoking 2. Rules Respecting Tenancies and Use of the Units and Family Dear Owners: Attached you will find two updated sets of rules, as follows. 1. Rules Respecting Smoking Ottawa Public Health suggests that the smoking of all products – including recreational and medicinal cannabis, tobacco and shisha – be banned in apartments and condos as well as on balconies. Ottawa’s acting medical officer of health Dr. Vera Etches states that “Second-hand smoke can disperse through a building, traveling between adjacent units through cracks in walls and ceilings, windows, and heating and ventilation systems.....there is currently no available or reasonably anticipated ventilation or air cleaning system that can adequately control or significantly reduce the health risks of second-hand smoke.” The existing smoking rules have been amended and updated by the Board, with the assistance of Property Management and our corporate legal counsel. The new Rules (copy attached) were passed by resolution of the Board at a meeting held on March 23, 2018. 2. Rules Respecting Tenancies and Use of the Units and Family Article 4.1 (a) of our Declaration states as follows: “The dwelling units shall be occupied and used for residential purposes as defined in and in conformity with the zoning and property standards by-laws of the City of Ottawa and for no other purpose.” To clarify and further define this statement, the existing rules have been amended and updated by the Board, with the assistance of Property Management and our corporate legal counsel. The new Rules (copy attached) were passed by resolution of the Board at a meeting held on March 23, 2018. The Condominium Act provides that owners must be formally notified of rule changes before the rules come into effect. The Board of Directors hereby gives notice to the owners of these updated rules and reminds owners of their right to request a meeting to amend or repeal the rules. The Corporation is required to hold such a meeting where 15% of the unit owners make such a . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . request for any section or sub-section of the attached rules. Specific text from Sections 46 and 58 of the Condominium Act describing these provisions are included herein. Any request to hold a meeting must be made in writing to the President, OCSCC 815 at the Corporation’s address (Front Desk, 90 George Street, Ottawa, Ontario, K1N 0A8) by using the prescribed forms that can be found on the Government of Ontario website no later than June 5th, 2018. The owners’ request for a meeting must specifically identify which subsection(s) of the rules is (are) the subject of contention. The attached rules will become effective on June 5th, 2018 unless a meeting of the owners is requested.
